Terms of Service

These terms (“Terms”) form a binding agreement between you (“you”, the business signing up) and AnswerSmith (“we”, “us”) for use of the AnswerSmith AI phone receptionist service (the “Service”). By creating an account, starting a free trial, or using the Service, you accept these Terms.

1. The Service

AnswerSmith provides an AI-powered phone receptionist that answers calls forwarded to a UK mobile number assigned to your account. The AI greets the caller in your business name, takes details of the enquiry, optionally checks your connected calendar, and may book an appointment or take a message on your behalf. We text you a summary after each call where the caller leaves details.

The Service depends on third-party providers including Vapi (voice AI), Twilio (telephony and SMS), Anthropic (language model), Deepgram (speech transcription) and Cal.com (calendar). Their availability affects ours.

2. Account and your obligations

  • You must be at least 18 and authorised to enter contracts for your business.
  • You are responsible for keeping your login credentials secure.
  • You will provide accurate information about your business and your callers' opening hours, services and emergency rules so the AI can answer correctly.
  • You will not use the Service to break the law, harass anyone, send unsolicited marketing calls, or impersonate another business.
  • You confirm that you have the right to receive calls on the AnswerSmith number assigned to you and to record those calls in accordance with applicable law.

3. Free trial

We offer a 14-day free trial when you choose to start one from your dashboard. A valid payment method is required to begin the trial. Nothing is charged during the trial. If you do not cancel before the trial ends, your subscription begins automatically at the plan price shown at sign-up.

4. Subscription, billing and cancellation

  • The Service is billed monthly in advance via our payment processor.
  • Prices are shown in GBP and exclude VAT where applicable.
  • You may cancel at any time from the billing portal in your dashboard. Cancellation takes effect at the end of the current billing period and the AI stops answering after that date.
  • We may change pricing on 30 days' notice. Continued use after the change is acceptance.
  • Refunds are at our discretion. We will consider reasonable requests for service-level failures.

5. Acceptable use

You agree not to:

  • resell, sublicense or white-label the Service without our written consent;
  • attempt to reverse-engineer, scrape, or interfere with the platform;
  • use the Service for outbound dialling, marketing campaigns, or any activity prohibited by Ofcom or the ICO;
  • use the Service in a way that endangers life (the AI is not an emergency service — callers reporting emergencies should be redirected to 999).

6. AI limitations

The AI receptionist is a probabilistic system. It may misunderstand callers, get details wrong, or book the wrong slot. You remain solely responsible for confirming details with your customers and for the work you carry out for them. We do not warrant that the AI's output is accurate, complete, or fit for any specific purpose, and we are not liable for business losses caused by AI errors. You should review every booking and message before acting on it.

7. Recording and call data

Calls to your AnswerSmith number are recorded and transcribed so the AI can summarise them, book appointments and identify returning callers. The first message of every call informs the caller of recording and that they are speaking with an AI. You agree that your use of the Service in this way is lawful in the jurisdictions where you and your callers are located. How we handle that data is described in our Privacy Policy.

8. Availability

We aim for high availability but do not guarantee uninterrupted Service. Planned downtime, third-party outages, and force majeure may all interrupt the AI. If the AI is unavailable, your existing phone line continues to ring as normal. We do not credit or refund for outages of our third-party providers unless required by law.

9. Liability

To the maximum extent permitted by law, our total liability to you under or in connection with these Terms in any 12-month period is limited to the fees you have paid us for the Service in that period. We are not liable for indirect, consequential, or special losses, including lost profits, lost business, lost goodwill, or lost data. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under law.

10. Intellectual property

We own the Service, the AnswerSmith brand, and all underlying software. You own your business data and call records. By using the Service, you grant us a worldwide, non-exclusive licence to process your data as needed to operate and improve the Service.

11. Termination

We may suspend or terminate your account immediately if you breach these Terms, if your payment fails and is not cured within a reasonable period, or if continued use would expose us to legal risk. You may close your account at any time.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in the dashboard at least 14 days before they take effect.

13. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that we may bring claims against you in any country where you are based.
